Terms & Conditions
These Terms & Conditions govern the use of this website and the purchase of products from NOYSH 360 doo.

2. Products
All products displayed on our website are subject to availability.
We reserve the right to modify, discontinue or update products, product descriptions and pricing at any time without prior notice.
We make reasonable efforts to display product colors, images and descriptions as accurately as possible. However, the appearance of colors may vary depending on the device and display used.
3. Prices and Payment
All prices are displayed in EUR (€) and include applicable taxes unless otherwise stated.
Available payment methods are displayed during checkout.
Online payments are processed securely through authorized payment providers.
4. Order Process
After placing an order, the customer will receive an order confirmation electronically.
The sales contract is considered concluded once the order has been confirmed and accepted for processing by NOYSH.
We reserve the right to cancel an order where a product is unavailable, payment cannot be processed, incorrect information has been provided, or where there is reasonable suspicion of fraudulent or unauthorized activity.
If payment has already been collected for an order that we cancel, the applicable amount will be refunded.
5. Delivery and Fulfilment
Orders are processed and shipped according to the delivery information provided on our website.
Delivery times may vary depending on the destination, courier service and circumstances outside our reasonable control.
Shipping within Montenegro costs €4.00.
For deliveries to Serbia, Bosnia and Herzegovina and Croatia, applicable shipping charges are calculated based on the delivery destination and displayed during checkout before the order is completed.

6. Card Payments
Card payments are processed in cooperation with Monri and Hipotekarna Bank AD through the Monri Payment Gateway using a secure and certified payment process.
Online card payments can be made using Visa and Mastercard, subject to availability and authorization.
Customers enter the required card information through the secure payment process in order to complete the transaction.
NOYSH does not store complete payment card details on its own systems.
7. Payment Currency
All payments are processed in euros (€).
Where a card is denominated in another currency, the transaction amount may be converted into the cardholder’s local currency according to the exchange rates and conditions applied by the relevant Visa/Mastercard card network and/or card issuer.
8. 3D Secure
Our webshop uses the 3D Secure security protocol for supported online card payments.
3D Secure provides an additional security layer and may require the cardholder to verify their identity through their card-issuing bank before the transaction can be completed.
9. Installment Payments
Installment payments are available exclusively to holders of the Premium card issued by Hipotekarna Banka with BIN number 516971.
Eligible purchases may be paid in up to 6 installments, subject to the applicable terms and conditions of the bank.
10. Returns and Right of Withdrawal
Customers have the right to withdraw from their distance purchase within 14 days of receiving the goods without giving a reason, subject to applicable consumer protection law.
To exercise this right, the customer must notify us of the decision to withdraw by a clear statement, for example by email to:
Returned products should be returned unused, unworn and unwashed, with original tags attached and, where reasonably possible, in their original packaging.
The customer may be responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
This does not affect statutory rights relating to defective or non-conforming goods.

Return shipping costs are borne by the customer unless the item was delivered damaged, defective or non-conforming and applicable law requires NOYSH to bear those costs.
11. Refunds
Once a returned item has been received and inspected, an approved refund will be processed using the original payment method.
Approved refunds are generally processed within approximately 5–7 working days after the returned goods have been received and inspected.
Where an order was originally paid by payment card, partial or full refunds will be processed back to the applicable Visa or Mastercard card through the payment processing system.
The time required for the refunded amount to appear in the customer’s account after NOYSH has processed the refund may depend on the bank, card issuer or payment provider.
12. Complaints
Customers may submit complaints concerning non-conforming or defective products, warranties, incorrect charges or other consumer matters in accordance with the time limits provided by applicable consumer protection law.
For non-conforming goods, statutory conformity rights may apply for up to two years from delivery, subject to the conditions and notification periods provided by applicable law.

NOYSH 360 doo will respond to a consumer complaint in writing without undue delay and no later than 8 days after receiving it.
13. Conformity and Defective Products
NOYSH is responsible for delivering goods that conform to the sales contract.
Statutory conformity rights apply in accordance with applicable consumer protection law.
For new goods, NOYSH may be responsible for a lack of conformity that becomes apparent within two years from delivery.
Where a product is defective or does not conform to the contract, the customer may be entitled, depending on the circumstances and applicable law, to repair or replacement and, where the relevant legal conditions are met, an appropriate reduction in price or termination of the contract with a refund.
The costs necessary to bring non-conforming goods into conformity are borne by NOYSH where required by applicable law.
These statutory rights are separate from the 14-day right of withdrawal for distance purchases.
14. Privacy and Personal Data
Personal information provided when using our website, placing an order or otherwise interacting with NOYSH is processed in accordance with our Privacy Policy and applicable data protection requirements.
15. Applicable Law
These Terms & Conditions and purchases made through our webshop are governed by the laws of Montenegro, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Where mandatory consumer protection provisions applicable to a customer cannot legally be excluded or restricted, those mandatory rights remain unaffected.
16. Changes to These Terms
We reserve the right to update these Terms & Conditions where necessary, including to reflect changes to our services, payment methods, business operations or applicable legal requirements.
Changes do not affect orders already concluded under an earlier version unless required by applicable law.
The version published on our website at the relevant time will apply.
